   We had booked Paintworks this new year 2020, we purchased a non refundable booking via booking.com. This means that we could not voluntarily change or cancel the booking of our own free will. COVID-19 lockdown restrictions were then announced, this necessitated Paintworks to close and prevented us from legally travelling out of our tier 4 area. Paintworks absolutely refused to refund us in spite the fact that they could not legally accommodate us nor fufil any contractal obligations with us during our scheduled booking. This is illegal, if you are in this situation please be aware of your consumer rights. Paintworks continued to quote booking.com's non refundable policy, however booking.com agreed that this was not enforceable if the cancellation occured due to legal closure of the apartment. Phil at Paintworks also absolutely refused to acknowledge the fact he had sent me Paintworks terms and conditions following my booking which explicitly stated that should Paintworks need to cancel my booking then we are owed a refund. To cut a long and stressful story short, Booking.com made the property aware that they must refund us and (as of today) they continue to protest with baseless arguements. Booking.com have assured us that if the property don't refund us then booking.com will and they will then chase the property themselves. Overall, I am astounded by the poor customer service and lack of understanding of legal and contractual obligations. I am so relieved I have managed to resolve this thanks to booking.com, if anyone else is in a similar situation I also recommend raising a Section 75 Credit Card Act Dispute or Chargeback (debit cards) with your bank. We have rights and they must also be respected.
